1. Introduction

These terms and conditions govern the use of the Scan4people application (the "Application"). The Application is provided by Scan4people AG, a company incorporated in Switzerland (hereinafter referred to as "Scan4people", "we", "us" or "our").

By using the Application, you agree to be bound by these terms and conditions, our privacy policy and any other policies that we may publish on the Application from time to time. If you do not agree with these terms and conditions, please do not use the Application.

2. Use of the Application

You may use the Application only for lawful purposes and in accordance with these terms and conditions. You agree not to use the Application:

in any way that breaches any applicable local, national or international law or regulation;

in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

for the purpose of harming or attempting to harm minors in any way;

to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;

to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam);

to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

3. Intellectual Property Rights

The Application and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof) are owned by Scan4people and are protected by Swiss and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may use the Application only for your personal, non-commercial use, and you agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Application without our express written consent.

4. Disclaimer of Warranties

The Application is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Application or the information, content, materials, or products included on the Application.

We do not warrant that the Application, its servers, or any email sent from us are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the Application, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

5. Limitation of Liability

In no event shall Scan4people be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use the Application.

6. Indemnification

You agree to indemnify, defend, and hold harmless Scan4people, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your use of the Application (including negligent or wrongful conduct) by you or any other person accessing the Application using your account.

7. Severability

If any provision of these terms and conditions is found to be invalid or unenforceable by a Swiss court, such 

provision shall be severed from the remaining terms and conditions, which shall remain in full force and effect.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Switzerland, without giving effect to any principles of conflicts of law. You agree that any dispute arising out of or in connection with these terms and conditions or the use of the Application shall be subject to the exclusive jurisdiction of the Swiss courts.

9. Modification of Terms

We reserve the right to make changes to these terms and conditions from time to time. If we make changes, we will post the updated terms and conditions on the Application and update the effective date at the top of this page. Your continued use of the Application after any changes have been made to these terms and conditions indicates your acceptance of the new terms.
